State and public authorities have to use eSPap\u2019s platform to receive invoices. Vendors must use UBL 2.1 CIUS-PT or CEFACT CIUS-PT to send signed e-invoices. To provide you with the most up-to-date information, below you can find the latest published deadlines, information about the national coordinating body, the Portuguese invoice standard, and more.<\/p>\n<h2><strong>eSPap\u00a0and\u00a0the Invoice Standard Known as\u00a0CIUS-PT\u00a0<\/strong><\/h2>\n<p lang=\"EN-US\" xml:lang=\"EN-US\"><a href=\"https:\/\/www.espap.gov.pt\/Paginas\/home.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">eSPap<\/a>\u00a0(Entidade\u00a0de Servi\u00e7os\u00a0Partilhados\u00a0da\u00a0Administra\u00e7\u00e3o\u00a0P\u00fablica) is the coordinating body for the implementation of electronic invoicing (e-invoicing) in Portugal. With\u00a0<a href=\"https:\/\/dre.pt\/web\/guest\/home\/-\/dre\/117514514\/details\/maximized?res=pt\" target=\"_blank\" rel=\"noreferrer noopener\">Legislative Decree 123\/2018<\/a>\u00a0from\u00a0December 28th, 2018,\u00a0eSPap\u00a0was granted the authority to do\u00a0the following:<\/p>\n<ul>\n<li>Set technical and functional requirements to support e-invoicing\u00a0implementation<\/li>\n<li>Develop support tools for\u00a0involved parties<\/li>\n<li>Provide a solution for receiving and processing e-invoices<\/li>\n<\/ul>\n<p>Unlike many other countries in the European Union, Portugal does not have a national\u00a0<a href=\"https:\/\/peppol.eu\/who-is-who\/peppol-authorities\/\" target=\"_blank\" rel=\"noreferrer noopener\">Peppol authority<\/a>.\u00a0In situations like this, when there is no national Peppol authority in a country,\u00a0OpenPeppol AISBL\u00a0acts as the authority.<\/p>\n<p lang=\"EN-US\" xml:lang=\"EN-US\">The accepted invoice formats for B2G e-invoicing in Portugal are UBL 2.1 &#8216;CIUS-PT&#8217; and CEFACT &#8216;CIUS-PT&#8217;. These invoice formats comply with the European Standard\u00a0<a href=\"https:\/\/peppol.helger.com\/public\/menuitem-en16931\" target=\"_blank\" rel=\"noreferrer noopener\">EN 16931-1<\/a>.<\/p>\n<h2><strong>FE-AP\u00a0and\u00a0B2AP\u00a0<\/strong><\/h2>\n<p lang=\"EN-US\" xml:lang=\"EN-US\">The implementation of the\u00a0so-called\u00a0Electronic Invoice Solution in Public Administration is based on two solutions for electronic invoicing:<\/p>\n<ul>\n<li>Business to AP (B2AP):\u00a0This portal is for suppliers to government agencies to monitor\u00a0electronic invoice delivery and status (in a pilot phase)<\/li>\n<li>Electronic Invoicing Portal for Public Administration (FE-AP): This portal is for government agencies with the purpose of invoice receipt and verification\u00a0(in production)<\/li>\n<\/ul>\n<p lang=\"EN-US\" xml:lang=\"EN-US\">The FE-AP solution has been piloted by three clients of the\u00a0GeRFiP\u00a0solution and is now gradually being distributed to public entities.\u00a0The FE-AP offers the possibility of receiving invoices and correcting documents in\u00a0an\u00a0electronic format, ensuring control and supervision at all stages of the process.\u00a0This solution is available to any public entity and offers direct integration with the\u00a0<a href=\"https:\/\/www.gerfip.gerall.pt\/Paginas\/home.aspx?ReturnUrl=%2f\" target=\"_blank\" rel=\"noreferrer noopener\">GeRFiFiP solution<\/a>, as well\u00a0as with\u00a0web services\u00a0or\u00a0any other accounting or document management system.<\/p>\n<h2 lang=\"EN-US\" xml:lang=\"EN-US\"><strong>Key Deadlines and Compliance\u00a0\u00a0<\/strong><\/h2>\n<p lang=\"EN-US\" xml:lang=\"EN-US\">Portugal was one of the first countries to meet the deadline set forth by the\u00a0European Union. In fact, Portuguese government agencies have been able to receive e-invoices since April 18th, 2019. However, as mentioned above, Portugal is mandating e-invoicing in phases, the next of which\u00a0is to\u00a0enforce\u00a0government suppliers to send electronic invoices.<\/p>\n<p lang=\"EN-US\" xml:lang=\"EN-US\">But that\u2019s not all. For different types of companies\u00a0(defined by\u00a0the European Commission (<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:32003H0361&amp;from=PT\" target=\"_blank\" rel=\"noreferrer noopener\">Recommendation 2003\/361\/EC<\/a>)),\u00a0different deadlines apply:<\/p>\n<ul>\n<li><strong>LARGE ENTERPRISES<\/strong>, those which employ more than 250 people or have an annual turnover of more than EUR 50 million\u00a0or have\u00a0an annual balance sheet total of more than EUR 43 million, there is an obligation to send e-invoices from<strong>\u00a0January 1st, 2021\u00a0<\/strong><\/li>\n<li><strong>MID-SIZE ENTERPRISES<\/strong>, those which employ fewer than 250 people and their annual turnover does not exceed EUR 50 million and\/or their annual balance sheet total does not exceed EUR 43 million, it is\u00a0mandatory to send e-invoices from\u00a0<strong>July 1st, 2021\u00a0<\/strong><\/li>\n<li><strong>SMALL ENTERPRISES<\/strong>, those with fewer than 50 employees with an annual turnover and\/or an annual balance sheet total of no more than EUR 10 million, it is mandatory to send e-invoices from<strong>\u00a0July 1st, 2021\u00a0<\/strong><\/li>\n<li><strong>MICRO-ENTERPRISES<\/strong>, those with fewer than 10 employees with an annual turnover and\/or an annual balance sheet total of no more than EUR 2 million, it is mandatory to send e-invoices from\u00a0<strong>January 1st, 2022\u00a0<\/strong><\/li>\n<\/ul>\n<h2 class=\"MsoNormal\" style=\"margin: 26.25pt 0in 22.5pt; line-height: normal; background: white;\"><strong>E-invoice Requirements Portugal<\/strong><\/h2>\n<p>Each e-invoice must have the following:<\/p>\n<ul>\n<li>Unique invoice identifier (transmission date, company information, and recipient)<\/li>\n<li>QR code as of 1st January 2022<\/li>\n<li>ATCUD as of January 1st, 2023<\/li>\n<li>An electronic signature in electronic invoices in PDF format to ensure they are valid as from 1st July 2022.<\/li>\n<\/ul>\n<p>Companies should have a system that verifies the signature\u2019s validity as of July 31, 2022. The <a href=\"https:\/\/www.portaldasfinancas.gov.pt\/at\/html\/index.html\"><em>Autoridade Tribut\u00e1ria e Aduanera (AT)<\/em><\/a> must certify a system or software solution for companies to add the ATCUD and the QR code.<\/p>\n<p>ATCUD is a unique ID number in an invoice and is a fragment of the information of the QR code. The ATCUD number has the following format; ATCUD: Validation Code-Sequential number.<\/p>\n<p>Taxpayers get the first part of the ATCUD (validation code) by communicating the document series to the AT. The taxpayer must also give other items such as type of document and first document number of the series. Afterward, AT delivers a validation code that is valid for at least a fiscal year for the whole document series.
